    A font license is simply an agreement that gives you permission to use a font.

    It's designed to allow the use of fonts across these main channels, to provide a wider user base, with a cohesive cross-platform experience.

    It depends on the corporation or business size. From XS, most likely for independent designers or smaller companies, to L for bigger corporations.
    We offer four different tier sizes: XS — S — M — L.

W END USER LICENSE AGREEMENT — EULA

1. Opening

This is a legally binding contract between the Licensee and W Type Foundry™. The License Owner or Licensee is the corporation, brand, or business for who the typeface is at service and in use, not the agency or commissioned designer responsible for creating the work. By purchasing, downloading, installing, or manipulating font software (“Font(s)”) offered by W Type Foundry™, you (“Licensee”) understand and agree to be bound by the terms and conditions of this License Agreement.

You are purchasing the rights to use the fonts as specified in this agreement. You are not purchasing the copyright to the design or any other part of the fonts, nor rights to distribute, sell or give away the fonts.

The use of any of the Licenses described below must correspond to what is stated in your invoice information.

CROSS MEDIA LICENSE

W Type Foundry™ Cross Media License grants Licensee non-exclusive, and non-transferable license to use the specified font(s) as stated by the invoice information.

a. Print License.
Desktop installation; according to its specified number of workstations.

b. Web License.
Web installation; according to the number of visitors the web may serve, calculated on a monthly basis.

c. Social Media License.
Social Media applications; according to the combined amount of followers across three main channels; Instagram, Twitter, and Facebook.

a. Desktop / Print License

— License Owner is the end client for who the typeface is in use – not the commissioned designer or agency.

— The Desktop / Print License is calculated based on the number of workstations font(s) will be installed in. The number of workstations is referenced on the invoice. If the number of workstations increases, the license must be updated.

— The Desktop / Print License is perpetual but non-transferable. In the case of the closure or merging of business entities, the license and the font(s) cannot be transferred.

— All licensed workstations must legally belong to the same company or entity purchasing the font. If the company or entity employs any third parties or temporarily-employed freelancers, a separate license is necessary for those parties.

— The Licensee may not use the font(s) to create alphabet or letterform products for resale where the product consists of individual letterforms where the likeness of the font(s) can be reproduced and the end-user of said products can create their own typesetting. An extended license may be available for an additional fee.

— The Licensee may not use dingbats, illustrations or images in the font(s) in a manner where the illustration or image becomes the primary aspect of a product for resale. An extended license may be available for an additional fee.

— The font(s) are provided in OTF format and may be used offline only. The Licensee can make security copies of the font(s) as long as they remain inaccessible to external parties.

— When embedded in production files, a copy of the font(s) may be temporarily provided to printer, prepress or such. Unless they are manipulating text or design using W Type Foundry™ font(s), in which case an individual license is necessary.

— The font(s) may be embedded into public PDF files as vector outlines.

— Print-font(s) must not be used to generate web-font(s).

a.1 Restrictions

— The Licensee may not use the font(s) as is in the logo or word mark of the company or License Owner brand. A Logo License is available for an additional fee, this will depend on the size of the company. Contact W Type Foundry™ at hola@wtypefoundry.com for more information.

b. Web License

— The Licensee may install the font(s) onto one (1) website property of the company or license owner brand.

— The Web License is calculated based on the number of total visitors the website may serve, dependent on the license purchased and referenced on the invoice. If the number of visitors increases, the license must be updated.

— The Web License is perpetual but non-transferable. In the case of the closure of a website or merging of business entities, the license and the font(s) fonts cannot be transferred.

— The Web License visitor number is calculated on a monthly basis / views per month.

— Web License font(s) are provided in WOFF format and must be self-hosted on the Licensee’s server(s).

— Web-fonts cannot be generated from print-fonts or other files. The provided Web-fonts cannot be used for any other purposes than what's defined by this license.

c. Social Media License

— The Licensee may use the font(s) on social media platforms, serving a specified number of followers as indicated on the Licensee’s invoice, based on the combined total of followers across all the Licensee's social media channels.

— If the number of followers increases, the license must be updated accordingly.

— The Social Media License is perpetual but non-transferable. In the case of the closure of a channel, the font(s) and/or the license to use the font(s) cannot be transferred.

— The font(s) are provided in OTF format.

c.1 Restrictions

— Social Media License does not include YouTube, nor video streaming platforms. For YouTube content or advertising contact W Type Foundry™ at hola@wtypefoundry.com for a Broadcasting License.

2. Provision to third Parties

All licensed workstations must legally belong to one business entity. For any third party agents such as temporarily-employed freelancers, printers, independent contractors, independent developer, etc. a Desktop / Print License Extension is needed for them to be treated as licensed users and count toward the number of users specified on the Invoice. For Third Party License Extension contact W Type Foundry™ at hola@wtypefoundry.com

Third party agents must:
a. Agree in writing to use the font(s) exclusively for Licensee’s work, according to the terms of this EULA.
b. Retain no copies of the font(s) upon completion of the work.

3. Copyright

The font(s) is protected by copyright law. W Type Foundry™ is the sole, exclusive owner of all intellectual property rights, including rights under copyright and trademark law. Licensee agrees not to use the font(s) in any way that infringes the intellectual property rights of the Foundry or violates the terms of this EULA. Including but not limited to; redistributing, reselling, giving out for free, sharing, or any commercial or non-commercial activities not allowed by this agreement.

Licensee will be held legally responsible, and indemnify W Type Foundry™, for any infringements on the Foundry’s rights caused by failure to abide by the terms of this EULA.

4. Modifications

Licensee may not modify the font(s) files, or create derivative font(s) based on the font(s).

5. Other Usage

Licenses for computer applications, computer and/or software plug-ins, computer games, installable interactive books, software, mobile applications and games, Ebooks and Epubs, product creation websites, website template distribution, website templates, digital marketplace, broadcasting and other uses not allowed by this EULA may be available for an additional fee. 6. Warranty and Support

W Type Foundry™ emphasizes providing font(s) on high quality standards and free of defect.

Licensee can ask for a fix in case of font(s) malfunction for fifteen (15) days since the date of purchase, specified on the Invoice. Claims must include the corresponding invoice and documentation of the defect.

Refunds are granted only when software defects cannot be resolved by W Type Foundry™ within 30 days since the first information of the problem.

In case of a refund, the respective license and all rights to use the font(s) terminate immediately.

The Product is provided “as is” W Type Foundry™ makes no warranty of any kind, either expressed or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose. W Type Foundry™ shall not be liable for any direct, indirect, consequential, or incidental damages, like; damages from loss of business profits, business interruption, loss of business information, etc.

7. Breach of Contract / Termination

This EULA is effective until terminated. Any breach of the terms and conditions of this agreement automatically terminates your license to use the fonts. All copies of the font(s) must be destroyed, including backup copies. Failure to comply with this EULA obligates the Licensee to pay for all costs of the licenses breached plus a fine depending on the kind of breach. The licensee is still obligated to obey this EULA.

8. Applicable Law and Court of Jurisdiction

This W Type Foundry™ EULA is governed by the laws of Chile.

Any dispute arising from this agreement falls exclusively under Chilean law. The Licensee expressly accepts the jurisdiction of the Chilean courts over any dispute arising from this agreement, even if the violation of contractual rights takes place in a foreign country. The exclusive place of jurisdiction is Santiago, Chile.

The Licensee agrees to cover all legal fees arising from any dispute over the breach of this EULA. Including reimbursement to W Type Foundry™ for all legal fees arising from a dispute over the breach of this agreement, such as; costs of investigation and attorneys’ fees.

9. Marketing

For marketing reasons only, W Type Foundry™ is entitled to use (repost, archive, share on social media and/or web) any applications of the licensed font(s) made public by the Licensee. Including but not limited to; company’s name, trademarks, branding and/or images or videos of the font(s) in use.

10. Entire Agreement

This EULA, in conjunction with the Invoice that accompanies each font(s) licensed from W Type Foundry™, constitutes the entire agreement between W Type Foundry™ and Licensee. You agree to be bound by the terms of this contract. All verbal communications and prior communications regarding the application of the licensed font(s) are not valid or effective.

Any and all rights not expressly granted in this agreement are reserved to W Type Foundry™.


FREE FONTS — PERSONAL USE LICENSE

W Type Foundry™ Personal Use License grants Licensee a non-exclusive, non-transferable license to use the specified font(s) as stated by the invoice information.

For a single user, one desktop computer, personal use, with non-commercial purposes.

a. Desktop / Print License

— Desktop installation; for one workstation (one computer).

— Application of the fonts(s) to create graphics, logos and artwork.

— The created graphics may be a fixed size (e.g. JPG, PNG, etc.) or a static vector (e.g. SVG, EPS, etc. made with a “create outlines” tool).

— The created graphics can be printed.

— Fonts are provided in OTF format.

b. Social Media License

— The Licensee can use the font(s) on Social Media platforms serving up to 10K (ten thousand) followers combining three main platforms; Instagram, Facebook and Twitter.

— The social media license allows the use of the fonts(s) on social media platforms including, but not limited to, Snapchat, Pinterest, Linked In and Tumblr.

— Fonts are provided in OTF format.

1. Requirements & Restrictions

Licensee may not use the Font for commercial purposes; to create branding or other kinds of design or salable products for any other business entity, commissioned designer or agency. Licensee may not use the Font to create alphabet or letterform products for resale where the product consists of individual letterforms, including rubber stamps, die-cut products, stencil products, or adhesive sticker alphabet products where the likeness of the Font can be reproduced and the end-user of said products can create their own typesetting. Social Media License does not include YouTube. For YouTube content or advertising contact W Type Foundry™ at hola@wtypefoundry.com for Broadcasting License.

Adding 50% of the license fee in case the use or applications surpass $ 3.900 USD. Licensee is still obligated to obey this EULA.

This W Type Foundry™ EULA is governed by the laws of Chile.

Any dispute arising from this agreement falls exclusively under Chilean law. The Licensee expressly accepts the jurisdiction of the Chilean courts over any dispute arising from this agreement, even if the violation of contractual rights takes place in a foreign country. The exclusive place of jurisdiction is Santiago, Chile.

The Licensee agrees to cover all legal fees arising from any dispute over the breach of this EULA. Including reimbursement to W Type Foundry™ for all legal fees arising from a dispute over the breach of this agreement, such as; costs of investigation and attorneys’ fees.

6. Marketing

For marketing reasons only, W Type Foundry™ is entitled to use (repost, archive, share on social media and/or web) any applications of the licensed font(s) made public by the Licensee.


ON REQUEST LICENSES

App / SaaS

— App licenses allow you to embed fonts in phone/tablet apps and SaaS products. The Licensee may embed font(s) onto one (1) App title owned or controlled by the Licensee. Serving the specified number of downloads as referenced on the Licensee’s invoice.
— In the case of an increase in downloads, the license must be updated.
— The Licensee may not redistribute the font(s) with the App’s source code.
— The Licensee may not install the font(s) in the operating system the App runs on.
— The Licensee may not embed the font(s) in an App that enables an end user to create custom typesetting with the font(s) (e.g. Photoshop Express for iOS, etc.).
— In the case of discontinuance, the font(s) and/or the license to use the font(s) cannot be transferred.


Logo / Wordmark Extension

— The Licensee may use the font(s) in the logo or wordmark of the company or License Owner brand, product, or service.


Digital Ads

— The Licensee may apply font(s) onto Digital Advertisements. Serving the specified number of impressions as referenced on the Licensee’s invoice.
— Embed the Font Software into a Digital Marketing Communication in a manner in which the Font Software cannot be fully or partially extracted.
— In the case of an increase of impressions, the license must be updated.
— In the case of the closure or merging of business entities, the license and the font(s) cannot be transferred.


YouTube

— The Licensee may feature the font(s) on the YouTube platform for one (1) channel with unlimited episodes and views. Serving a specified number of subscribers as referenced on the Licensee’s invoice.
— In the case of an increase in subscribers, the license must be updated.
— This License covers worldwide geographic territory and languages.
— In case of cancelation of channel, discontinuance or merging of business entities, the license and the font(s) cannot be transferred.
— Broadcasting fonts are provided in OTF format.


Streaming

— The Licensee may feature the font(s) on an online Streaming platform for one (1) title. Serving a specified number of monthly views, as referenced on the Licensee’s invoice.
— In the case of an increase in views, the license must be updated.
— This License covers worldwide geographic territory and languages.
— In case of cancelation of service, discontinuance, or merging of business entities, the license and the font(s) cannot be transferred.
— Broadcasting fonts are provided in OTF format.


Broadcasting

— The Licensee may feature the font(s) on On-land broadcasting; TV, TV Network, Cable TV and cinema for advertising, video clips, titles, subtitles, opening and ending credits, etc. for one (1) title or License owner brand.
— This License may have geographic territory and language limitations, as referenced on the Licensee’s invoice.
— In the case of needing to cover more territory and / or languages, the license must be updated.
— This License allows for unlimited episodes, reruns, screenings, (etc.) for one (1) title or License Owner brand.
— In case of cancelation, discontinuance or merging of business entities, the broadcasting license and the font(s) cannot be transferred.
— Broadcasting fonts are provided in OTF format.


Computer Game / Software License

— Embedding fonts in Computer Games / Software Titles.
— The Licensee may embed font(s) onto one (1) title owned or controlled by Licensee. Serving the specified number of downloads as referenced on the Licensee’s invoice.
— In the case of an increase of downloads, the license must be updated.
— The Computer Game / Software License allows Licensee to port the title to any other platform or console (iOS, Windows, Android, Linux, PlayStation, Xbox, etc.
— The Licensee may not embed the font(s) in an Computer Games / Software that enables an end user to create custom typesetting with the font(s) (e.g. Photoshop Express for iOS, etc.).
— In the case of discontinuance, the font(s) and/or the license to use the font(s) cannot be transferred.


eBook / ePub

— Embed fonts into one eBook or ePub title. Serving the specified number of downloads as referenced on the Licensee’s invoice.
— In the case of an increase in downloads, the license must be updated.


Corporate

— The Corporate License adds "unlimited" to the use or applications on the platforms referenced in the Cross Media License. This can also be tailored depending on your needs, complementing with other licenses.


Server

— Install the font on a server that will allow the generation of items such as PDF invoices, custom business cards, or other personalized products. Serving the specified number of downloads as referenced on the Licensee’s invoice.
— The price is based upon the number of servers on which the font is installed, as well as the number of users that have access to it.
— The Server license allows your team or customers to utilize the fonts you have purchased to customize the products that you offer, but the fonts can not be distributed or downloaded from the server.
— A font downloaded with this license cannot be used in SaaS, where the service is the product rather than the item that is created.
— In the case of discontinuance, the font(s) and/or the license to use the font(s) cannot be transferred.
